The General Terms and Conditions of Kul-Tur d.o.o. apply.

  1. GENERAL PROVISIONS

These general terms and conditions for travel are an integral part of the contract or. vouchers made by Kul-Tur d.o.o., Prvačina 64 / a, 5297 Prvačina, Slovenia (hereinafter referred to as Kul-tur doo) or. authorized agency and traveler applying for a particular tourist arrangement. When signing the contract, the passenger is familiar with the general conditions and instructions and irrevocably agrees with them! The General Terms and Conditions apply only to tourist arrangements organized by Kul-tur doo, unless explicitly stated that they also apply to the sale of arrangements by other organizers. In the case of telephone sales or sales and / or sales with other forms of electronic communication, it is considered that the traveler has accepted the provisions of these General Terms and Conditions when ordering a tourist arrangement by telephone or other form of electronic communication. In the case of, that otherwise specified in the specific terms of business or individual program regarding any point in these General Terms and Conditions shall be stated. provision specified in the program. Client or traveler is any person who has made a valid reservation or made a purchase and payment for a tourist arrangement or other service of Kul-tur doo and is referred to in these General Terms and Conditions for Tourist Arrangements. 

 

  1. APPLICATION

The traveler can sign up for a tourist arrangement organized by Kul-tur doo through thesaltoflife.com. Upon check-in, Kul-tur doo and the passenger enter into a contract, which is at the same time a booking confirmation, which contains information about the passenger’s tourist arrangement or refers to the program of the arrangement, where this information is provided. Upon check-in, the traveler is obliged to provide all the information and submit the documents required by the travel program and to pay the registration fee and the cost of the check-in. When a traveler registers in writing for the trip, his / her application is confirmed when he / she returns to Kul-tur doo a signed contract and a certificate of paid application and registration fee (copy of letter of credit or general payment slip) within the deadline set on the program. According to the decision and price list of the Association of Travel Agencies of Slovenia Kul-tur doo for its services it charges the subscriber standard reservation costs according to the valid price list, which is published prominently. In case the passenger does not provide the correct information at check-in, he is responsible for all costs or expenses. consequences resulting from incorrect information. Passenger registration is obligatory. It may only depart from it in accordance with the provisions of the passenger’s cancellation. In addition to the express written application or signed contract, any order forwarded in oral or written form, containing the name of the passenger and other participants, credit card number or identification of another payment instrument, payment of the application fee or a part thereof, payment of costs shall be considered a binding application. an application or a conclusive act indicating that the passenger has submitted a binding application or application, containing any of the above information. The contract is considered to be concluded on the day of confirmation by Kul-tur doo via email. 

 

III. SERVICES INCLUDED IN THE PRICE OF THE ARRANGEMENT

Unless otherwise stated in the program, the price of the arrangement includes the transport, hotel and catering services listed in the program of the trip under the heading “price includes”, as well as the organization of the trip and the compulsory insurance. Excluded are all services that are not explicitly mentioned in the “price includes” or. are listed in the “price does not include” section. Unless otherwise specified in the program, the prices of an individual tourist arrangement per person are valid for accommodation in double rooms. 

 

  1. SPECIAL SERVICES

Special services are those services which, as a rule, are not included in the price of the arrangement (single room, special meals, optional extra excursions, etc.) or are subject to additional charges (visas, airport fees, etc.) in the program, so the passenger pays them separately, except unless otherwise specified in the program. In the event that special or special invitations are issued to an individual arrangement. additional services, the traveler wishes for these services upon check-in, and they are extra charged for the price of the arrangement. Published prices of additional or special services apply only in the case of ordering and paying for these services, when ordering and paying for the basic arrangement at the check-in point. During the journey itself, the traveler pays special services to the tour manager or to the representative of Kul-tur doo in the place where the service is provided, in the appropriate currency, if the service can still be ordered during the trip, at a price, 

 

  1. PAYMENT

The day of payment is considered to be the day on which Kul-tur doo receives payment into the company’s transaction account. The check-in fee and the booking fee paid by the passenger upon check-in are 30% of the price of the package, respectively. as much as stated in the travel program. The rest is paid by the passenger at least 14 days before the start of the journey, or as stated in the program. In the event that the rest of the price of the arrangement is not paid by the passenger or his / her check-in point within the stipulated time, he / she is considered to have canceled the arrangement, and the provisions regarding the passenger’s cancellation of the arrangement from these general conditions and instructions for tourist arrangements shall apply mutatis mutandis. Timely and properly paid travel, registration fees and check-in costs are warranted to the traveler, under the conditions set out in these General Terms and Conditions for Tourist Arrangements, or under the conditions set out in the specific terms of business or program, participation or vacancy in a particular tourist arrangement or trip. Upon departure, the traveler is required to submit a document on the paid arrangement (contract / referral / voucher or / and payment receipt); otherwise, the person responsible for the journey may not be accepted by the traveler. arrangement. The passenger may pay by cash or by other means of payment. In accordance with the terms of business of financial institutions, in the case of cash or non-cash payment (credit card, maestro, BA,…) of a tourist arrangement or other service of Kul-tur doo, in no case can Kul-tur doo pay the cash, however, the traveler may request a credit made by the agency through the bank to the passenger TRR, of course if he is entitled to it. When a travel arrangement is booked by a licensed travel agency, 

 

  1. PRICES

Prices for travel are determined by the travel or vacation program and are valid from the date of publication of the program. Kul-tur doo reserves the right to change the price in case of changes in the exchange rates or changes in the tariffs of carriers that affect the price of travel, in accordance with the law governing the obligations and regulations in force in the Republic of Slovenia . Kul-tur doo informs the passenger about any change in the price of the trip. In the program, Kul-tur doo may stipulate that the passenger will pay for the services provided on the spot. In this case, Kul-tur doo does not act as an organizer, not as an intermediary, but merely as an informant. In this case, the passenger claims all claims only from the on-site service provider. Kul-tur doo may set the price of the arrangement in the program, stating explicitly, that the price may be reduced if a certain number of passengers are checked in or other well-defined conditions arise. Such a provision does not in any way guarantee that the conditions for the reduction of the price of the arrangement will be entered into and the traveler cannot withdraw from the contract because the conditions for a possible reduction of the price would not occur. Kul-tur doo may set the price of the package in the program, stating explicitly that the price can be increased if a certain number of passengers will sign up or other well-defined conditions will occur. The passenger checks in at the best price possible, but is aware and irrevocably agrees to the extra charge between the optimal and minimum passenger participation. Should a smaller number of passengers decide to travel, we will notify you of the changed conditions at least one week before departure. In any event, such a provision does not state that the conditions for an increase in the price of the arrangement will be met, and that provision is provided for in the travel certificate or travel program. The passenger can withdraw from the contract if the price increase exceeds ten percent of the agreed price without having to compensate for the damage and the organizer returns the amount paid to the passenger. Any discounts and benefits are mutually exclusive and are not cumulative. If more discounts are provided, the traveler can choose the discount that suits him best. If the tour operator determines that he or she is obliged to make a substantial change to one of the essential contractual conditions before departure, he / she is obliged to inform the passenger as soon as possible in order to enable him / her to make the appropriate decision, in particular to withdraw from the contract without having to compensate or conclude Annex. 

 

VII. TRAVEL DOCUMENTS

A traveler applying for a trip abroad must have a valid passport or other valid document with which he or she can enter the country. In the event that individual countries make entry into a country subject to a certain period of validity of the travel document before expiry on the day of entry, the passenger is obliged to pay attention to these provisions and Kul-tur doo is not responsible for any inconvenience or forcible termination of travel. The passenger is obliged to travel before or after the trip. obtain visas for the countries to which he or she travels and undergo the vaccinations required for those countries by the deadline specified in the program. If the passenger does not fulfill this obligation, Kul-tur doo complies with the provisions on the passenger’s cancellation of the trip. It is considered that the passenger regulates the visa himself when Kul-tur doo does not deliver the necessary documents for the visa arrangement within the period specified in the program or offer. Due to the requirements in international passenger transport (air, ship, bus, etc.), the passenger is obliged to correctly provide all the necessary information about all the participants of the trip or flight that he or she is registering upon check-in. The information must be in full conformity with the information in the official documents which the travel participants are obliged to carry with them in accordance with the regulations on crossing the state border and the relevant foreign legislative acts. In the event that incorrect information results in delay, additional costs or interruption of the trip, the passenger is solely responsible for all costs incurred by the participants in the trip. bus…) the passenger is obliged to correctly provide at the check-in all the necessary information about all participants of the trip or holiday he / she is applying for. The information must be in full conformity with the information in the official documents which the travel participants are obliged to carry with them in accordance with the regulations on crossing the state border and the relevant foreign legislative acts. In the event that incorrect information results in delay, additional costs or interruption of the trip, the passenger is solely responsible for all costs incurred by the participants in the trip. bus…) the passenger is obliged to correctly provide at the check-in all the necessary information about all participants of the trip or holiday he / she is applying for. The information must be fully consistent with the information in the official documents which the travel participants are obliged to carry with them in accordance with the regulations on crossing the state border and the relevant foreign legislative acts. In the event that incorrect information results in delay, additional costs or interruption of the trip, the passenger is solely responsible for all costs incurred by the participants in the trip. 

 

VIII. PASSENGER CANCELLATION OR CHANGE IN TRAVEL

The passenger has the right to terminate the contract in whole or in part at any time. If the consumer is unable to attend the trip, he may transfer his reservation to another consumer who meets the requirements provided for the particular trip. The consumer must inform the tour operator or the seller not later than eight days before the start of the trip, but at a time when all the documents necessary for crossing the border and the smooth execution of the trip can be timely arranged. Travel cancellation is by email. In case the passenger cancels the arrangement, Kul-tur doo has the right to reimbursement for the cancellation of the trip. The amount of reimbursement depends on the time at which the passenger submitted the cancellation. If the traveler cancels the arrangement, he is obliged to Kul-tur doo reimbursement of administrative costs in the amount of the reservation costs stated on the reservation price list. The amount of reimbursement of the cancellation fee depends on the time before the day of commencement of the service in which the passenger submitted the cancellation or otherwise canceled the trip:

  • immediately after signing up to the amount of 25% of the price of the arrangement
  • 90 to 60 days before the start of the trip 35% of the price of the package
  • 59 to 45 days before the start of the trip 50% of the price of the package
  • 44 to 30 days before the start of the trip 65% of the price of the package
  • 29 to 22 days before the start of the  trip  70% of the price of the package
  • 21 to 15 days before the day of commencement of the trip  75% if no arrangement
  • 14 to 8 days before the start of the trip 80% of the price of the package
  • 7 to 1 day before the start of the trip 90% of the package price
  • without cancellation or travel. non-participation 100% of the price of the arrangement.

Cancellation costs never exceed 100% of the price of the arrangement. The amount of the cancellation fee when Kul-tur doo is not a tour operator is determined by the general conditions or other act of the organizer. Notwithstanding the costs of cancellation specified above, they may also be higher when conditioned by the travel arrangements required by Kul-tur doo to be determined by the applicable terms of sale and by business partners. If the conditions for reimbursement for cancellation of travel are otherwise specified in the program, the conditions set out in the program shall apply. Upon cancellation of the voyage, the traveler must sign the cancellation document offered to him by the seller. If he refuses to sign this document, he shall be deemed not to have canceled the trip. During the voyage, the passenger may terminate the voyage at his request and by giving a written statement of termination. If the traveler interrupts the journey during the journey, he / she shall not be entitled to reimbursement or partial or full refund on return. If the traveler changes the program during his travel or does not travel according to the program, which is an integral part of the contract with Kul-tur doo, it is considered that the traveler has terminated the contract during the trip. In this case, the passenger is responsible for the costs and damages caused by it. In the event of a change of the program on its own request, or due to force majeure, without there being reasons on the part of Kul-tur doo for improperly rendered service, the passenger has no right to claim any compensation or reduction of the price. The passenger may change the name or number of passengers, accommodation, date of travel after the conclusion of the contract, provided that such change is possible without cancellation of the arrangement. In case of change of charge Kul-tur doo the administrative costs of the passenger in accordance with the applicable reservation price list, and in cases where the costs are higher, in particular where the arrangement also includes air transport and cancellation / changeover services, it shall reimburse the actual costs. If the tour operator significantly changes the travel program before completing the contract, he must refund to the traveler who, as a result, withdraws from the trip all the amount paid to him.

 

  1. ODSTOPNINA

If, upon check-in, the passenger assumes that he may not attend the trip due to certain circumstances (which may occur with him or his immediate family), he may pay a cancellation fee, but at least seven days before departure. The severance agreement is valid in the case of formal appeals, unexpected deterioration of health or death in the immediate family (spouse, parents, children) and can only be enforced upon submission of the relevant certificate. The amount of the allowance is stated in the travel contract or the travel program. The program may specifically determine a different amount of the withdrawal fee or that the withdrawal fee is not possible. Regardless of the fee paid, Kul-tur doo has the right to reimburse the administrative costs specified in the reservation price list in the event of a passenger’s cancellation of travel. If the traveler does not start the day, which is designated as the beginning of the journey and does not cancel the journey prior to the start, shall not be entitled to claim a refund on the basis of the paid leave. It is also considered that the passenger did not start the journey or canceled the contract when the carrier (air, ship, bus, etc.) does not accept the passenger for any reason, which may be of a security or regulatory nature, regardless of whether happened while traveling or at the beginning of the trip. In such a case, the passenger is responsible for all the damage caused and cannot claim any refunds based on the paid compensation. In other cases, documented force majeure that does not belong to the events covered by the cancellation and which causes the passenger to cancel the trip or withdraw from the contract, Kul-tur doo has the right to reimbursement of all its expenses, as well as those incurred; arising from the mere cancellation of the trip. Force majeure must be documented with valid official documents and such that it could not have been foreseen or avoided prior to the conclusion of the contract. A claim for claim of a cancellation cannot be claimed after the date of commencement of the journey or. holidays, as well as during unused part of the journey or holiday. In the event that the traveler takes out a travel cancellation insurance with one of the insurance companies, the passenger’s rights under the cancellation claim shall be exercised with that insurance company, applying the general conditions of the insurance company. A claim for claim of a cancellation cannot be claimed after the date of commencement of the journey or. holidays, as well as during unused part of the journey or holiday. In the event that the traveler takes out a travel cancellation insurance with one of the insurance companies, the passenger’s rights under the cancellation claim shall be exercised with that insurance company, applying the general conditions of the insurance company. A claim for claim of a cancellation cannot be claimed after the date of commencement of the journey or. holidays, as well as during unused part of the journey or holiday. In the event that the traveler takes out a travel cancellation insurance with one of the insurance companies, the passenger’s rights under the cancellation claim shall be exercised with that insurance company, applying the general conditions of the insurance company. 

 

  1. CUSTOMS AND FOREIGN EXCHANGE RULES

The passenger is obliged to comply with all customs and foreign exchange regulations of the Republic of Slovenia, as well as all other countries to and through which he travels. If the traveler is unable to continue traveling due to non-compliance with the regulations, he or she shall bear all the consequences and costs incurred in connection with this and all passengers. 

 

  1. CANCELLATION OR CHANGE OF THE PROGRAM

In accordance with applicable law, Kul-tur doo reserves the right to cancel the trip or to change the travel program and reserves the right to cancel the trip no later than 7 (seven) days before the scheduled departure, if the required number of passengers is not indicated for the trip. Unless otherwise stated in the program, the minimum number of passengers in a given vehicle is as follows: – for bus travel – at least 45 passengers on the bus, – for travel on scheduled routes in Europe – at least 30 passengers in each group, – for travel on intercontinental routes – at least 15 passengers in each group, – for journeys by special aircraft, trains or ships – at least 80% of their occupancy. Kul-tur doo reserves the right to withdraw from the contract in whole or in part, if, before or during the implementation of the program, exceptional circumstances arise that could not have been expected, removed or avoided, and for Kul-tur doo, these circumstances constitute a valid reason for not concluding the contracts if they existed at the time of the conclusion of the contract. Kul-tur doo may terminate the contract or withdraw from the contract and claim damages from the passenger who directly violates the provisions of the contract concluded with Kul-tur doo, especially if it is found that the passenger intentionally provided incorrect information on the number of passengers or their age, or there were changes during the trip, but the passenger did not inform Kul-tur doo. Kul-tur doo reserves the right to change the day and time of departure or departure. to the cancellation of the trip, due to the change of the flight schedule or the occurrence of force majeure, and the right to change the direction of travel, if the conditions for travel change (new timetable, precarious position in the country where the program is organized, natural disasters or other unforeseen causes beyond the control of Kul-tur doo), without special compensation and according to the regulations in force in passenger traffic. Kul-tur doo cannot accept responsibility for changes to the program due to the occurrence of any force majeure during the course of the program. In such cases, it may provide passengers with services in a modified form, according to existing options. In case Kul-tur doo cancels the trip, the passenger has the right to the full refund of the paid price of the package. In the event of cancellation of the trip by Kul-tur doo, the traveler is not entitled to reimbursement of the visa costs required to enter the country of travel or the vaccination costs required by the program. It shall immediately inform the passenger of any subsequent modification of the Kul-tur doo program. Kul-tur doo is not responsible for delays of aircraft, ships or trains, as well as for program changes that would result from such delays. In case the on-site situation of Kul-tur doo does not allow the placement of passengers in the ordered facility, Kul-tur doo may place the passenger in another facility of the same category. If the tour operator significantly changes the travel program before completing the contract, he / she shall refund to the traveler, who consequently withdraws from the trip, all the amount paid to him / her. If the tour operator significantly changes the program during the fulfillment of the contract, the traveler who withdraws from the contract therefore only pays for the costs of the services actually provided. ships or trains, as well as for program changes resulting from such delays. In case the XII. COMPLAINTS OF COMPLAINTS

The traveler must report any irregularities or deficiencies on the spot to Kul-tur doo’s guide, direct service provider, representative or authorized local agency. In the event that the content of the complaint could be resolved on the spot (for example, lack of cleanliness of the room, equipment, location of the room, etc.), and the passenger did not complain about the error on the spot and did not inform the above mentioned persons, that the traveler has consented to the service thus rendered, thereby losing the right to make subsequent complaints by requesting a reduction in the price of the service or payment of damages. The passenger may file a complaint in writing within the statutory period of two months. Without a written complaint, Kul-tur doo does not deal with claims for price reductions, claims for damages and other claims. The passenger should send a written complaint to: Kul-tur doo, Prvačina 64 / a, 5297 Prvačina. The complaint must be signed and can be filed by each passenger on his own behalf or by a third party in writing. The authorization must be attached to the complaint, otherwise Kul-tur doo will not handle such a complaint. The complaint must be substantiated. The traveler should therefore enclose with the complaint the relevant evidence and / or the relevant certificate of the hotelier, carrier, other relevant persons about the factual situation on the basis of which the passenger claims his claim. This provision shall not apply in the event that Kul-tur doo has the right to cancel the arrangement or to change the program, in accordance with the provisions of these General Terms and Conditions. The authorization must be attached to the complaint, otherwise Kul-tur doo will not handle such a complaint. The complaint must be substantiated. The traveler should therefore enclose with the complaint the relevant evidence and / or the corresponding certificate of the hotelier, carrier or. other relevant persons about the factual situation on the basis of which the passenger claims his claim. This provision shall not apply in the event that Kul-tur doo has the right to cancel the arrangement or to change the program in accordance with the provisions of these General Terms and Conditions. The authorization must be attached to the complaint, otherwise Kul-tur doo will not handle such a complaint. The complaint must be substantiated. The traveler should therefore enclose with the complaint the relevant evidence and / or the corresponding certificate of the hotelier, carrier or. other relevant persons about the factual situation on the basis of which the passenger claims his claim. This provision shall not apply in the event that Kul-tur doo has the right to cancel the arrangement or to change the program, in accordance with the provisions of these General Terms and Conditions. 

 

XIII. HEALTH REGULATIONS

According to the regulations of the World Health Organization, the traveler is obliged to vaccinate and to obtain an appropriate document for traveling to certain countries. Vaccination is also mandatory if such a regulation is adopted after the conclusion of the travel contract; this is not a justifiable reason to terminate the contract insofar as there are no contraindications to the passenger’s health. In this case, the passenger is required to submit a medical certificate. In the event that the travel program indicates or. certain vaccinations are required, each passenger must obtain an international certificate himself / herself – a yellow booklet, with the completed vaccinations. Kul-tur doo is not responsible for any complications or interruption of the travel due to the passenger’s non-compliance with the health regulations of the country he / she enters or the program to which he / she signed up, as well as for the costs related thereto. 

 

XIV. LUGGAGE

The organizer, agent or broker is not responsible for the transportation of luggage, they are not responsible for the lost or lost luggage, nor for the theft of luggage and / or other valuables at the hotel. Luggage lost or damaged shall be reported to the carrier or hotel by the passenger himself. To carry special luggage, such as bicycle, surf, golf equipment …, the passenger must pay an extra charge to the carrier, usually upon departure directly at the airport in accordance with the carrier’s conditions. In any case, it is obligatory to announce the carriage of such luggage at check-in, and the airline reserves the right to refuse the carriage of such luggage in any case due to the limited capacity. All costs or damages resulting from this shall be borne by the passenger 

alone. The price of luggage is determined by the carrier and an indication of the weight to which the luggage is free of charge. Each additional kilogram of luggage weight is paid for by the passenger on the spot in the appropriate currency or on the spot. as determined by the air carrier. For air transport, baggage is the sole responsibility of the airline, in accordance with the regulations in force in international air passenger transport. In case of loss of luggage, the passenger fills in the PIR form of the airline that performed the transport and hands it over to the representative of the airline and keeps one copy for himself. On the basis of the form, the airline pays him compensation, according to the regulations in force in international passenger traffic. Kul-tur doo is not responsible for the theft or damage to passengers’ luggage or other personal effects, valuables and documents from accommodation facilities (hotel rooms, apartments, etc.). 

 

  1. CARRIER ACCURACY AND MEANS OF TRANSPORT

Kul-tur doo is not responsible for the accuracy of land, sea and air transport when operated by public means of transport, regular or extraordinary passenger transport, navigation or flights. The liability of the carriers is duly specified in the contract between the passenger and the carrier, which enters into force using the means of transport. Kul-tur doo shall not be liable for any damages arising from delays, cancellations or changes in the transportation or means of transport. Kul-tur doo reserves the right to change the timetable, types of buses, planes, carrier and direction of flight (intermediate stops, return via other airport, etc.), which occur for various technical and organizational reasons. Delays can also occur, most often due to congestion of transport corridors, strikes and bad weather, however, the organizer has no influence on them. The changes referred to in the previous paragraph shall not be considered as changes to the travel program in the package arrangements, since the first and last days of the trip are intended exclusively for arrival and departure at the destination and related transport, as well as for rest. The quality of means of transport is, as a rule, unless otherwise indicated by the average category. 

 

XVI. LOSS OF DOCUMENTS

If the traveler loses documents or is stolen during the journey, but is absolutely necessary to continue the journey or to return home, the traveler shall provide new ones at his own expense. When arranging formalities in this regard, the passenger may contact the travel manager for advice and assistance. In the event that the traveler has to cancel the trip due to the loss or theft of documents, he is not entitled to any reimbursement of the paid trip or reimbursement. 

 

XVII. NOTIFICATIONS BEFORE DEPARTURE / TRAVEL

For travel, the passenger receives a final notification no later than one week before departure; the passenger is obliged to give the correct address of service at the time of check-in. The damage that would result from the passenger giving an incomplete or incorrect address for the purpose of completing the referral / voucher or contract shall be borne by the passenger. 

 

XVIII. ARRANGEMENTS WHERE Kul-tur doo is NOT a JOURNEY ORGANIZER

In cases where Kul-tur doo is not a tour operator, it acts as an intermediary. In these cases, he or she gives the information received from the tour operator to the passenger and assists him / her in registering for the trip. The conditions of registration, payment and eventual cancellation of the trip are in accordance with the applicable conditions of the other organizer. Such programs are appropriately marked (that Kul-tur doo is not the main organizer but the intermediary), and the mark will also be given on the travel certificate. Any complaint can be made by the passenger to the main organizer of the arrangement as well as to the intermediary. 

 

XIX. INFORMATION

The information provided by the traveler at the check-in point does not oblige Kul-tur doo more than the indications in the program or offer. In case of doubt, it shall always be considered valid: a written offer, written information or written explanation. Check in or out. the journey is made when the traveler pays the aro. The order of registration is at the same time the seat number of the bus or bus. on a trip. Optional information entry is not considered as an application.
